Plaintiff was the owner of a 250-unit apartment building in Irvine, California, who sought over $40 million in damages due to construction defects that included allegations of significant waterproofing failures caused by the client who was the target defendant during a 72-day binding arbitration. Although the arbitrator awarded Plaintiff in excess of $30 million after prevailing on nearly all of its claims, Springel & Fink’s waterproofing client was found not liable for any damages awarded to Plaintiff, nor to the general contractor for its contractual indemnity and attorneys’ fees claims.
